Badger Carwash Membership Terms & Conditions

By enrolling in the Badger Carwash Membership Program, you agree to be bound by these Terms and Conditions. Please read them carefully before joining. AquaShine Holdings, LLC, doing business as Badger Carwash, owns and operates the facility located at 109 E. Ave B, Lampasas, TX 76550.

1. Membership Overview

Program Description
The Badger Carwash Membership Program provides members with access to unlimited automatic car washes at the Badger Carwash location, subject to these Terms. The wash is open 24 hours per day, except during maintenance, repairs, or weather-related closures.

Membership Tiers
We offer tiered membership options: Deluxe, Premium, and Ultimate. Pricing and wash inclusions are displayed at the pay station and on our website.

Unlimited Washes / Fair Usage Policy
Badger Carwash Memberships provide unlimited washes per month, subject to a fair usage policy. Members may wash their registered vehicle up to one (1) time per calendar day. The program is intended for personal use only. Badger Carwash reserves the right to monitor usage and may suspend or terminate memberships that show signs of abuse, excessive use inconsistent with normal consumer behavior, or commercial use (such as rideshare, dealership, or fleet operations).

Vehicle Limitation
Each membership is linked to a single vehicle by its license plate number and cannot be shared, transferred, or used on multiple vehicles.

Family Accounts
Multi-vehicle (family) accounts are available. Please contact Badger Carwash at 512-575-3031 or info@badgercarwash.com for pricing and setup assistance.

Vehicle Restrictions
Membership is valid for standard passenger vehicles only. Vehicles exceeding 7 feet in height, 96 inches in total width, or longer than a standard 4-door long-bed truck are not permitted. Trucks with ladder racks, trailer hitches, uncovered beds with debris, or full-size Hummers are prohibited.
Vehicles must be suitable for automatic car washes. Members are responsible for ensuring that beds are empty and that no debris can be dislodged during washing. Badger Carwash reserves sole discretion in determining vehicle eligibility.

Periodic Closures
Badger Carwash may temporarily close for repairs, weather, water restrictions, or other reasons. We make reasonable efforts to post closure updates via Google or Facebook. Membership fees continue during these closures, as membership provides access when the wash is open, not uninterrupted service. No refunds or credits will be issued for downtime.

Wash Malfunctions
In case of a malfunction, please contact Badger Carwash immediately at 512-575-3031.

2. Member Account Information

You agree to provide accurate and up-to-date personal information. Failure to do so may result in membership suspension or cancellation.

3. Membership Term and Renewal

Recurring Billing Authorization
By enrolling, you authorize a recurring monthly charge to your chosen payment method. Clicking “Done” during registration confirms agreement to these Terms.

Duration and Renewal
Memberships begin on the date of enrollment and automatically renew monthly until canceled.

Cancellation Policy
To cancel, members must contact 512-575-3031 or email info@badgercarwash.com at least five (5) days prior to renewal.
Cancellations made less than five days before renewal may result in one final billing cycle.

Failed Payments
If payment fails, one reattempt may be made. If unsuccessful, membership will be suspended until payment information is updated.

Chargebacks and Disputes
Before filing a chargeback, members must contact Badger Carwash to resolve any billing disputes. If unresolved, disputes will be handled through mediation or Lampasas County Small Claims Court (TX). Members are responsible for all costs, including legal fees and a $500 administrative fee, if Badger Carwash prevails in a chargeback dispute.

Verification
Badger Carwash uses license plate recognition and HD video systems to verify vehicle activity in any dispute.

4. Fees and Payment

Deluxe: $27/month
Premium: $36/month
Ultimate: $42/month

All prices are subject to change without notice. Applicable sales tax will be added to all charges.

5. Membership Usage and Restrictions

Wash Type: Memberships are valid only for the wash package associated with the purchased tier.
Fair Usage: Each membership allows one wash per vehicle per day. Badger Carwash reserves the right to suspend or terminate memberships used in violation of this policy.
Personal Use Only: Memberships are for individual consumer use. Commercial or business vehicles (including rideshare or fleet) are prohibited unless approved in writing.
Bay Availability: Wash bays are first-come, first-served. Availability is not guaranteed.
Non-Transferable: Memberships may not be shared or transferred.
Vehicle Condition: Members must ensure their vehicles are in safe condition for automatic washing.
Badger Carwash is not liable for damage resulting from improper vehicle preparation or pre-existing defects.

6. Cancellation and Termination

Member-Initiated Cancellation:
Call 512-575-3031 or email info@badgercarwash.com at least five (5) days before renewal.

Badger-Initiated Termination:
Badger Carwash may suspend or terminate any membership, with or without notice, for reasons including (but not limited to):

Violation of these Terms
Payment failure
Abuse or fraudulent use
Excessive washing or commercial use
Unsafe or unsuitable vehicles
Damage to property or equipment
Disruptive or inappropriate behavior toward staff
Posting false or defamatory public reviews without prior attempt to resolve

Refund Policy:

Member Cancellation: No refunds for unused time or washes.
Badger Termination Without Cause: Prorated refunds may be issued at Badger’s discretion.
Termination for Cause: No refund will be issued.

Upon cancellation or termination, membership access will immediately cease.

7. Disclaimer of Liability

Vehicle Damage
Badger Carwash is not responsible for damage to:

Vehicles taller than 84” or wider than 96”
Trucks with ladder racks, trailer hitches, or uncovered beds
Full-size Hummers
Vehicles with external racks, accessories, or modifications
Vehicles with bug shields, rain guards, or cracked/chipped windshields
Older vehicles (7+ years) with fragile trim or clear coat
Any pre-existing damage or aftermarket parts

All washing is at the vehicle owner’s risk.

No Warranty
All services are provided “as is” and “as available” without any warranty.

Customer Damage to Property
Customers are responsible for any damage they cause to carwash property, including equipment, vacuums, or infrastructure. Costs of repair or replacement will be billed to the responsible party.

8. Modification of Terms

Badger Carwash may modify these Terms at any time. Updates will be posted on www.badgercarwash.com. Continued use of the membership constitutes acceptance of any revised Terms.

9. Program Changes

Badger Carwash reserves the right to modify, suspend, or discontinue the Membership Program with reasonable notice.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Venue for any disputes will be in Lampasas County, Texas.

11. Entire Agreement

These Terms represent the full agreement between the Member and AquaShine Holdings, LLC dba Badger Carwash.
